Transfer price formation (TPF) is the setting of prices for goods, services and intangible assets that are transferred between related parties. Often, one of the parties to such transactions is a non-resident or does not pay income tax.

In the Republic of Belarus, TPF is regulated by Chapter 11 of the Tax Code of the Republic of Belarus (hereinafter – the TC of the RB) and other legislative acts. Transactions subject to market price compliance control by the Ministry of Taxes and Duties of the Republic of Belarus (the MTD of the RB), as well as methods for assessing market value are described in detail in Articles 91-96 of the TC of the RB.

On January 1, 2025, Law of the Republic of Belarus No. 47-Z dated 13.12.2024 entered into force, amending the TC of the RB including in relation to the control of TPF.

The tax authorities closely monitor that the prices set between related parties correspond to the market level and carry out checks on the application of transfer price formation.

Income tax payers are required to submit information to the Ministry of Internal Affairs of the Republic of Belarus on their controlled transactions during the tax period.
